Authority buys forester forest plot: expropriation or not?

A forester and the state forestry authority are in dispute over the exercise of a pre-emption right under the State Forest Act (LWaldG). A forester and forest owner acquires a forest plot by purchase agreement. However, there is a pre-emption right of the state for this forest plot. The state exercises this pre-emption right after the purchase of the forest plot. The forester defends himself in court.
