Farmer sells land – to commercial businesses: Tax office fully charges farmer

A farmer is closing his operation and transferred the business properties to private assets. He sells numerous properties to commercial businesses. On one of his properties, he expands an existing building in such a way that the tax inspector classifies it as a new construction. The tax office initially assessed the former farmer for income tax as declared. However, after an external audit, the tax office took the view that the former farmer had been a commercial real estate dealer. This had to be decided by a tax court. And in the end, the Federal Fiscal Court.
